Terms of Service

1. Acceptance of Terms

By accessing or using eStudent 360 ("the Platform"), operated by FacioTech Foundation, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. For users under 18, a parent or guardian must review and agree to these terms on the student's behalf before mentoring participation is enabled.

2. About the Platform

eStudent 360 is a free, cross-disciplinary student mentorship platform connecting students in Ghana and Canada with verified mentors. The Platform provides mentorship matching, career pathways, structured sessions, and messaging tools. We do not charge users for these services.

3. Eligibility & Age

  • Students must be at least 12 years old to create an account.
  • Students aged 12 to 17 need verified guardian consent before full mentoring participation.
  • Mentors must be at least 21 years old and pass our verification process.
  • Guardians must be the legal parent or guardian of a minor student.
  • Users must provide accurate and truthful information.

4. Account Registration

You are responsible for maintaining the security of your account credentials. You must not share your login information with others. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

5. User Conduct

You agree to:

  • Treat all users with respect and professionalism.
  • Not engage in harassment, discrimination, or abusive behaviour.
  • Not share inappropriate, harmful, or illegal content.
  • Not attempt to contact minors outside the Platform.
  • Not use the Platform for commercial solicitation or advertising.
  • Not attempt to circumvent safety features or monitoring.
  • Report any safety concerns to the Platform immediately.

6. Mentor Responsibilities

Mentors agree to:

  • Complete the verification process truthfully.
  • Maintain professional boundaries with students.
  • Communicate only through Platform-approved channels.
  • Not request personal contact information from students.
  • Report any safeguarding concerns promptly.
  • Provide guidance within their area of expertise.

7. Guardian Responsibilities

Guardians of minor students are responsible for reviewing and approving their child's use of the Platform, monitoring their mentorship activities, and providing or withdrawing consent as needed. Guardian consent is required before a minor's account is fully activated and is reviewed and renewed periodically (currently annually). See our Privacy Policy for how guardian consent and data rights are handled.

8. Safety & Monitoring

We employ safety measures to protect users, especially minors, which may include content monitoring, session oversight, and behavioural analysis. We may suspend or terminate accounts that violate these terms or pose safety risks. Where the law requires, we report suspected child abuse to the appropriate authorities.

9. Intellectual Property

The Platform, including its design, content, and features, is owned by FacioTech Foundation. Career-pathway content and educational materials are provided for personal, non-commercial use only. Content you create (messages, profile information) remains yours, but you grant us a limited license to host and use it as needed to operate the Platform.

10. Privacy & Cookies

Your use of the Platform is also governed by our Privacy Policy and Cookie Policy. By using the Platform, you acknowledge that you have read and understood these policies.

11. Disclaimers

  • eStudent 360 is provided "as is" without warranties of any kind.
  • We do not guarantee specific educational outcomes from mentorship.
  • Mentor advice is informational and does not constitute professional counselling.
  • We are not liable for the quality or accuracy of mentor guidance.

12. Limitation of Liability

To the maximum extent permitted by law, FacioTech Foundation shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

13. Termination

You may deactivate your account at any time through your account settings. We may suspend or terminate accounts that violate these terms, pose safety risks, or remain inactive for an extended period (currently more than 2 years). Upon termination, your data is handled according to our Privacy Policy.

14. Governing Law

For Ghana-based users, these terms are governed by the laws of Ghana. For Canada-based users, these terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

15. Changes to Terms

We may update these Terms from time to time. We will revise the "Last updated" date and communicate material changes via email or in-app notification before they take effect. Continued use of the Platform after changes take effect constitutes acceptance.
