Terms of Service

1. Acceptance of Terms

By accessing or using eStudent 360 (“the Platform”), operated by FacioTech Foundation, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. For users under 18 (or under 14 in Quebec, Canada), a parent or guardian must agree to these terms on your behalf.

2. About the Platform

eStudent 360 is a free, cross-disciplinary student mentorship platform connecting students worldwide with verified mentors. Currently live in Ghana and Canada, the Platform provides mentorship matching, career pathways, structured sessions, and messaging tools. We do not charge users for any services.

3. Eligibility

  • Students must be at least 13 years old (or have guardian consent if younger)
  • Mentors must be at least 21 years old and pass our verification process
  • Guardians must be the legal parent or guardian of a minor student
  • Users must provide accurate and truthful information

4. Account Registration

You are responsible for maintaining the security of your account credentials. You must not share your login information with others. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

5. User Conduct

You agree to:

  • Treat all users with respect and professionalism
  • Not engage in harassment, discrimination, or abusive behaviour
  • Not share inappropriate, harmful, or illegal content
  • Not attempt to contact minors outside the Platform
  • Not use the Platform for commercial solicitation or advertising
  • Not attempt to circumvent safety features or monitoring
  • Report any safety concerns to the Platform immediately

6. Mentor Responsibilities

Mentors agree to:

  • Complete the verification process truthfully
  • Maintain professional boundaries with students
  • Communicate only through Platform-approved channels
  • Not request personal contact information from students
  • Report any safeguarding concerns promptly
  • Provide guidance within their area of expertise

7. Guardian Responsibilities

Guardians of minor students are responsible for reviewing and approving their child’s use of the Platform, monitoring their mentorship activities, and providing or withdrawing consent as needed. Guardian consent is required before a minor’s account is activated and must be renewed annually.

8. Safety and Monitoring

We employ safety monitoring tools to protect users, especially minors. This includes content monitoring, session oversight, and behavioral analysis. We may suspend or terminate accounts that violate these terms or pose safety risks. We are legally obligated to report suspected child abuse to authorities.

9. Intellectual Property

The Platform, including its design, content, and features, is owned by FacioTech Foundation. Career pathway content and educational materials are provided for personal, non-commercial use only. User-generated content (messages, profile information) remains yours, but you grant us a license to use it for operating the Platform.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy and Cookie Policy. By using the Platform, you acknowledge that you have read and understood these policies.

11. Disclaimers

  • eStudent 360 is provided “as is” without warranties of any kind
  • We do not guarantee specific educational outcomes from mentorship
  • Mentor advice is informational and does not constitute professional counselling
  • We are not liable for the quality or accuracy of mentor guidance

12. Limitation of Liability

To the maximum extent permitted by law, FacioTech Foundation shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability for any claim shall not exceed CAD $100.

13. Termination

You may deactivate your account at any time through your account settings. We may suspend or terminate accounts that violate these terms, pose safety risks, or remain inactive for more than 2 years. Upon termination, your data will be handled according to our Privacy Policy.

14. Governing Law

For Ghana-based users, these terms are governed by the laws of Ghana. For Canada-based users, these terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Platform after changes constitutes acceptance.
